What is a process server? A process server is a person who serves legal proceedings on a defendant, witness or any other person named in legal proceedings. In New Zealand, a process server is often also a licensed private investigator with a law enforcement background or an individual that has a working knowledge of the law relating to the service of process.
According to the New Zealand legal process, all parties must be notified when facing legal proceedings in court or named as defendants. The notification of these proceedings is called the 'service of process' and is achieved by delivering the notice of legal proceedings and other important information relating to the matter by a process server.
A process server delivers legal documents to a defendant or parties involved in legal proceedings, the process server is required to serve the legal documents in accordance with the relevant legislation. This means, positively identifying the individual or parties concerned and personally handing the documents to them, if service is refused, the documents can be left at their feet or left in clear view of the individual concerned, they are then served!
Orders for substituted service can also be granted on application by the court in circumstances when it's impossible to effect service in the usual manner, this occurs when the parties concerned are actively avoiding service. The order for substituted service can instruct the process server to serve a relative or person that is believed to know the whereabouts or be in contact with the individual concerned.
Substituted service can also be made by an advertisement in the public notices column of a newspaper or a social networking website like Facebook or Twitter. The New Zealand High Court ruled that substituted service can be effectively served on a defendant or other party subject to legal proceedings via Facebook.
Posting on a recipient's Facebook page is a permissible means of substituted service if evidence establishes that the Facebook page is, in fact, that of the person to be served and the posting is likely to come to that person's attention, at the place he is to be served and in a timely fashion (refer CIV-2008-485-2676, High Court Wellington, 16 March 2009, Gendall AJ).
